The three surviving arches of the basilica were part of a huge public structure (100 x 65 m) built by Maxentius and Constantine I. It was used as the seat of city prefects and for judicial hearings or tribunals against senators.

In AD 626, Pope Honorius I removed bronze plaques from the roof to use on the old Basilica of St. Peters.
